Petr Bely called for the improvement of legislation in the field of intellectual property in pharmaceuticals

Peter Bely, Founder and Chairman of the Board of Directors of PJSC PROMOMED, delivered a report to the Federation Council on topical issues of intellectual property in the Russian pharmaceutical industry.

During his speech, Peter Bely noted that due to sanctions and restrictions, the domestic pharmaceutical industry is facing serious challenges, in particular, the inability to protect Russian innovations in European jurisdictions. He stressed that against the background of a real reduction in the number of international clinical trials and limited access to new developments, the key burden falls on Russian companies. According to Petr Bely, in responsible decisions of the state and the industry, it is important to maintain a balance between protecting the legitimate rights of copyright holders and preventing abuse of the patent system.

Pyotr Bely has come up with two important legislative initiatives. First of all, we are talking about the introduction of "mirror responsibility": In case of established abuse of patent law, liability comparable to liability for patent infringement must occur. In addition, it is proposed to recognize and legislate the fact of dishonesty in cases where foreign copyright holders are trying to achieve the cancellation of state registration of domestic drugs or other destruction of the results of investments in the Russian economy, which directly harms the industry and healthcare of our country.
