Promomed Group discussed approaches to the formation and protection of the patent portfolio at the congress in Moscow

On October 17, the lll Patent Congress was held in Moscow, where Maria Porokhnya, Director of Intellectual Property at Promomed Group, took part as a speaker.

Within the framework of the IP Pharma section, representatives of leading domestic pharmaceutical companies gathered at a round table to discuss topical issues related to the choice of patent strategy, approaches to the formation and protection of the patent portfolio of original products.

The discussion was moderated by Alexey Zalesov, PhD, Honorary President of the Russian national group AIPPI, Patent Attorney of the Russian Federation, Eurasian Patent Attorney, lawyer.

Following the meeting, the speakers noted that the transition of the Russian pharmaceutical industry from a generic model to an originator model can be called successful, since most domestic companies have a mixed product portfolio. At the same time, "patenting original medicines requires the creation of a unique effective patent strategy with the selection of a suitable patenting object for each specific product, taking into account its characteristics, which will improve commercialization. Textbook patenting strategies do not always turn out to be effective in today's realities," said Maria Porokhnya.

Representatives of the pharmaceutical market also agreed that the creation of a Russian pharmaceutical patent registry by analogy with the Eurasian one has not been successful and is unlikely to be successful in the foreseeable future, which, however, does not bother market participants, since they are accustomed to drawing more complete information about the patent protection of products from other sources.

There was also a discussion of thorny issues, such as the imposition of interim measures in patent infringement disputes, which, as noted by the participants in the discussion, has not yet been widely applied by Russian courts. "A ban on the transfer of the RU to other persons for the duration of the dispute may act as a measure to ensure the enforcement of the claim, but not restrictions that are essentially partial enforcement of the claim, such as the withdrawal of the RU or a ban on the sale of goods," Maria Porokhnya expressed her opinion.

The Patent Congress is one of the key events in the field of intellectual property. In Russia, it is conducted on an annual basis by the Russian National Group of the largest international Association for the Protection of industrial property, AIPPI.
