According to the head of PROMOMED, Bely, over 100 patents have been registered in the country in cooperation with Rospatent and the Center for Advanced Security Technologies.

At one of the SPIEF sessions, issues of intellectual property rights protection mechanisms in the Russian pharmaceutical industry were raised, as well as obstacles to its development. Even in the recent past, Russians have been treated with foreign drugs for decades, and the state has created conditions for the appearance of foreign medicines on the market. But after the mass withdrawal of Western pharmaceutical manufacturers, a paradox occurred. International clinical trials in Russia have fallen by almost 20 times. New foreign drugs will not come here - it is impossible, but foreign pharmaceutical giants continue to receive patents for their product.

Some legal regulation mechanisms are still set up so that foreigners feel confident in the market. Patents are extended indefinitely, even for 20 years. Formally, after four years, you can get a compulsory license, but this is too long for vital drugs. The issue of the so-called evergreen foreign patents worries the leaders of the Russian pharmaceutical industry, including the PROMOMED company .

"The availability of therapy, its sufficiency. You can't bring three jars into the country and say that we cured everyone. And price as a factor of accessibility. Using our example, I can talk about cooperation with Rospatent and the Center for Advanced Security Technologies. We have registered more than 100 patents alone. About 30 of them are from the last year alone," Bely cited such statistics.

Law should be technological and innovative, and lawyers should be involved at earlier stages of the entire process. Experts believe that public lawsuits, objections to "evergreen" patents, and the opinions of third parties during the examination are the best global practice for patient protection. Public control can be an effective tool here.

The cancellation of "evergreen" patents reduces the burden on the budget and makes drugs cheaper. Government and business should join forces to create clear rules to protect innovation.
